All e-cigarettes and heated tobacco products have been banned under the Prohibition of Electronic Cigarettes Act 2019.

What's allowed
  • Production, manufacture, import, export and sale of e-cigarettes is prohibited
  • Possession for personal use remains in a legal grey area
  • Heat-not-burn products are also covered by the ban
What's banned
  • Online sale and advertising to Indian consumers is prohibited
  • Some states impose additional penalties for use in public spaces

Penalties

First offence: up to ₹1 lakh fine and/or 1 year imprisonment. Repeat offence: up to ₹5 lakh fine and/or 3 years imprisonment.
